Federal Judge Blocks Biden’s Gas and Oil Lease Moratorium

On Tuesday June 15th, 2021, a Federal judge stood up to the climate change alarmists in the Biden Administration and blocked Biden’s gas and oil lease moratorium, claiming that Biden never presented a “rational explanation” for the ban on new leases.

According to the New York Post:

“US District Judge Terry Doughty sided with 13 states in granting a preliminary injunction that applies nationwide. The states challenging the moratorium were Louisiana, Alabama, Alaska, Arkansas, Georgia, Mississippi, Missouri, Montana, Nebraska, Oklahoma, Texas, Utah and West Virginia…

In his ruling, Doughty found that only Congress has the power to pause offshore oil and gas leases and ordered that plans be resumed for delayed lease sales for the Gulf of Mexico and Alaska. The judge also agreed with the states’ argument that a pause on oil and gas leases would do “irreparable injury ” by depriving them of revenue and causing massive job losses...

Doughty also agreed with the states that the administration enacted the pause without providing adequate notice or the ability to comment on the policy.”

The Blaze, in an article on the topic, also notes that, in Doughty’s opinion, Biden’s moratorium “violated the Outer Continental Shelf Lands Act and the Mineral Leasing Act, two laws designed to affirm the federal government’s intent to achieve energy independence using U.S. resources.”

In his decision, Doughty added that Biden’s oil and gas lease moratorium was a major financial problem for the states and communities involved, saying that “Millions and possibly billions of dollars are at stake. Local government funding, jobs for Plaintiff State workers, and funds for the restoration of Louisiana’s Coastline are at stake. Plaintiff States have a reliance interest in the proceeds derived from offshore and on land oil and gas lease sales.”

On a similar note, Louisiana’s Attorney General, Jeff Landry (R), called the judge’s decision “a victory not only for the rule of law, but also for the thousands of workers who produce affordable energy for Americans.”

He’s right. Biden destroyed thousands of jobs on day one of his administration with his attacks on the energy industry. This case is a big win.
